Notice of Intent to Amend Rules

The Wyoming State Board of Nursing (WSBN) is proposing to amend Chapter 5 – Fees. The revisions in Chapter 5 are intended to identify allowable methods of payment, clarify language, delete language and fees no longer being utilized, and add fees to align with the Nurse Practice Act (NPA).  
As WSBN is converting its current “Access” licensure database to a cloud-based comprehensive licensing, discipline, and education program management system, applicants will be required to use credit or debit cards to pay licensure fees on-line. Use of only credit or debit cards, as compared to money orders and cashier checks, for application payment improves efficiency and ultimately reduces license issuance time. To provide stakeholder’s flexibility, other payment sources may be utilized when requesting data. Language was also changed to refer to mailing lists, labels, and publications as data requests.  
In the fee schedule, language was changed to clarify the APRN fee. The word “retired” was also added to broaden the scope of the inactive license which allows a “retired” nurse to hold a license but does not allow the nurse to practice if he/she can no longer meet continuing competency for renewal using active nursing practice hours. 
Language was also deleted in the fee schedule which referred to a Temporary Permit pursuant to W.S. 33-21-132(b). This type of Temporary Permit is no longer used or needed due to enactment of the enhanced Nurse Licensure Compact in 2016. Other deleted language included “insufficient funds/check” as personal checks are not accepted.  
Other language was added to align with W.S. 33-21-138 and W.S. 33-21-140 of the NPA. These provisions provide the Board with authority to collect actual costs incurred for nursing education program approval, in addition to actual survey and approval costs incurred for periodic evaluation of nursing education programs
